Article 1 - Definitions

In these terms and conditions shall apply:

1. Entrepreneur: the natural or legal entity, who offers products and / or services to consumers by distance contract;

2. Consumer: the natural person not acting in the exercise of professional or business and a distance contract with the entrepreneur;

3. Day: calendar day;

4. Duration transaction: a distance contract concerning a range of products and / or services, the supply and / or purchase is spread over time;

5. Durable medium: any means that the consumer or business that enables information to him personally is directed to store in a way that future consultation and unaltered reproduction of the stored information.

6. Right of withdrawal: the ability for consumers within the waiting period to set a side the remote agreement;

7. Withdrawal period: the period during which the consumer can exercise his right of withdrawal;

8. Remote Agreement means an agreement whereby  within the confines of the system for distance selling of products and / or services organized by the entrepeneur, to conclude the agreement exclusive use of one or more means of distance communication;

9. Technology for distance communication: means that can be used to conclude a contract, without the consumer and trader being in the same area have come together.

Article 3 - Applicability

1. These general terms and conditions apply to every offer of the entrepreneur and any contract that is realized remote between entrepreneur and consumer.

2. Before the distance contract is concluded, the text of these general conditions has to be ​​available to the consumer. If this is not reasonably possible, before the distance contract is concluded, indicated that the general conditions at request of the consumer as quickly as possible must be available without any charge.

3. If the remote agreement is concluded electronically, then, contrary to the previous paragraph and before the distance contract is concluded, the text of these terms and conditions electronically to the consumer be made available in such a way that the consumer can store it easily on a durable medium. If this is not reasonably possible, before the distance contract is concluded, indicated where the general conditions in electronic form can be taken and that at the request of the consumer electronically or otherwise without charge will be sent.

Article 4 - The offer

1. If an offer has a limited duration or subject to conditions, this will be explicitly mentioned in the offer.

2. The offer includes a complete and accurate description of the offered products. The description is sufficiently detailed to allow a proper assessment of the offer by the consumer as possible. If the contractor uses these images are a true representation of the products offered. Obvious mistakes or errors in the offer are not binding on the entrepreneur.

3. Each offer contains such information, that clear to the consumer what rights and obligations are to the acceptance of the offer are attached. This concerns in particular:

- the price including taxes;

- any costs of delivery;

- how the agreement will be concluded and which actions this will require;

- whether or not to apply the right of withdrawal;

- the method of payment, delivery and performance of the contract;

- the way the consumer, for the conclusion of the contract, by him under the contract data to check and repair if necessary;

- in Dutch, the contract may be concluded in English;

- the conduct to which the trader is subject and the manner in which the consumer can conduct electronic consult and

- the minimum duration of the remote agreement in the event of an extended transaction.

 

Article 5 - The agreement

1. The agreement is subject to the provisions of paragraph 4, concluded at the time the consumer accepts the offer and meet the corresponding conditions.

2. If the consumer has accepted the offer electronically, the trader will immediately confirm receipt of electronic acceptance of the offer. Until receipt of this acceptance has not been confirmed by the entrepreneur, the consumer may rescind the contract.

3. If the agreement is created electronically, the trader will take appropriate technical and organizational measures to protect the electronic transmission of data and ensure a secure web environment. If the consumer can pay electronically, the trader will take appropriate safety precautions.

4. The entrepreneur can - within the law - inform the consumers of its payment obligations, as well as all facts and factors that are important to a sound conclusion of the distance contract. If the operator under this investigation was justified that  the agreement not to come true, he is entitled to a reasoned order or request to refuse or to implement special conditions attached.

5. The entrepreneur will enclose with the product the following information, in writing or in such a way that the consumer in an accessible manner can be stored on a durable medium, :

a. the visiting address of the establishment of the operator where the consumer can lodge complaints;

b. the conditions and the manner in which the consumer of the right of withdrawal may be exercised, or a clear statement regarding the exclusion of the right of withdrawal;

c. in Article 4 paragraph 3 of these Terms and Conditions, unless the operator this information already provided to the consumer prior to the execution of the agreement;

6. In the event of an extended transaction is the provision in the preceding paragraph shall apply only to the first delivery.

 

Article 6 - Right of withdrawal

1. When purchasing products, the consumer has the option to dissolve the contract without giving any reason during 7 days. If the order also contains food, then that 7 days no longer applies. Once an order is on its way, it can no longer be canceled. This cooling-off period commences on the day after the consumer receives the (non-food) product or a representative previously designated by the consumer and announced to the entrepreneur.

2. During the reflection period, the consumer will handle the product and packaging with care. He will only unpack or use the product to the extent necessary to assess whether he wishes to keep the product. If he makes use of his right of withdrawal, he will return the product with all accessories supplied and in the original condition and packaging to the entrepreneur, in accordance with the reasonable and clear instructions provided by the entrepreneur.

3. The consumer is only liable for depreciation of the product that is the result of a way of handling the product that goes further than allowed in paragraph 2

 

Article 7 - Exercise of the right of withdrawal by the consumer and costs

1. If the consumer makes use of his right of withdrawal, he must report this to the entrepreneur within the cooling-off period by means of the model withdrawal form or in another unambiguous manner.

2. As soon as possible, but within 14 days from the day following the notification referred to in paragraph 1, the consumer will return the (non-food) product or hand it over to the entrepreneur. This is not necessary if the entrepreneur has offered to collect the product himself. The consumer has in any case observed the return period if he returns the product before the cooling-off period has expired.

3. The consumer returns the (non-food) product with all accessories supplied, in original condition and packaging, and in accordance with the reasonable and clear instructions provided by the entrepreneur.

4. The risk and the burden of proof for the correct and timely exercise of the right of withdrawal lies with the consumer.

5. If the consumer makes use of his right of withdrawal, all additional agreements will be terminated by operation of law.

 

Article 8 - Costs in case of withdrawal

1. If the consumer makes use of his right of withdrawal, at most the costs of return will be for his account.

2. If the consumer has paid an amount, the entrepreneur will refund this amount as soon as possible, but no later than 30 days after the return or cancellation.

 

Article 9  - Handling returns

1. Upon receipt of the return, it is assessed whether the product has been returned in a timely and acceptable condition. This within the framework of the law on distance selling. After receiving the products, we review the return form for the desired solution and we will act accordingly. If there are any ambiguities as a result of a request, we will contact you by phone or e-mail as soon as possible. 

 

Article 10 - Exclusion of right of withdrawal 

1. The entrepreneur can exclude the right of withdrawal of the consumer insofar as provided for in paragraphs 2 and 3. The exclusion of the right of withdrawal only applies if the entrepreneur has clearly stated this in the offer, at least in time for the conclusion of the agreement.

2. Exclusion of the right of withdrawal is only possible for products:

a. that have been created by the entrepreneur in accordance with the consumer's specifications;

b. which are clearly of a personal nature;

c. which cannot be returned due to their nature;

d. that can spoil or age quickly;

e. the price of which is subject to fluctuations in the financial market over which the entrepreneur has no influence;

 

Article 11 - The Price

1. During the period of validity stated in the offer, the prices of the products and / or services offered will not be increased, except for price changes as a result of changes in VAT rates.

2. Contrary to the previous paragraph, the entrepreneur can offer products or services whose prices are subject to fluctuations in the financial market and over which the entrepreneur has no influence, with variable prices. This link to fluctuations and the fact that any stated prices are target prices are stated in the offer.

3. Price increases within 3 months after the conclusion of the agreement are only permitted if they are the result of statutory regulations or provisions.

4. Price increases from 3 months after the conclusion of the agreement are only permitted if the entrepreneur has stipulated this and:

a. they are the result of statutory regulations or provisions; or

b. the consumer is authorized to terminate the agreement with effect from the day on which the price increase takes effect.

5. The prices stated in the offer of products or services include VAT.

 

Aticle 12 - Compliance and warranty 

1. The entrepreneur guarantees that the products and / or services comply with the agreement, the specifications stated in the offer, the reasonable requirements of reliability and / or usability and the statutory requirements existing on the date of the conclusion of the agreement. provisions and / or government regulations. If agreed, the entrepreneur also guarantees that the product is suitable for other than normal use.

2. A guarantee provided by the entrepreneur, manufacturer or importer does not affect the statutory rights and claims that the consumer can assert against the entrepreneur under the agreement.

 

Article 13 - Delivery and implementation (see also by Delivery)

1. Vegan Mission will take the greatest possible care when receiving and implementing orders for products and when assessing applications for the provision of services. The delivery times specified by our webshop are only indicative. Exceeding any delivery period does not entitle you to compensation or the right to cancel your order or dissolve the agreement, unless the exceeding of the delivery period is such that you cannot reasonably be expected to maintain the agreement. In that case you are entitled to cancel the order or dissolve the agreement insofar as this is necessary.

Cooling: Most products at Vegan Mission have a long shelf life and can be transported without cooling. Free cooling elements are included for products from the refrigerator. Additional cooling elements are also available for sensitive products and / or the warmer periods. Vegan Mission is not liable for products that do not arrive cool.

2. The place of delivery is the address that the consumer has made known to Vegan Mission.

3. Subject to what is stated in article 4 of these general terms and conditions, Vegan Mission will execute accepted orders expeditiously but no later than within 30 days unless a longer delivery period has been agreed. If delivery is delayed, or if an order cannot or only partially be executed, the consumer will be notified of this no later than 30 days after he has placed the order. In that case, the consumer has the right to dissolve the agreement without costs and the right to any compensation.

4. In case of dissolution in accordance with the previous paragraph, the entrepreneur will refund the amount that the consumer has paid as soon as possible, but no later than 30 days after dissolution.

5. If delivery of an ordered product proves to be impossible, the entrepreneur will refund the amount of the ordered product within 7 days or the entrepreneur will contact the consumer to find a replacement article together. If no replacement product is found, Vegan Mission will refund the amount for the missing product within 7 days.

6. The risk of damage and / or loss of products rests with the entrepreneur until the moment of delivery to the consumer or a pre-designated and announced representative to the entrepreneur, unless expressly agreed otherwise.


Article 14 - Payment

1. Unless otherwise agreed, the amounts owed by the consumer must be paid within 14 days after the commencement of the cooling-off period as referred to in Article 6, paragraph 1. In the event of an agreement to provide a service, this period commences. after the consumer has received the confirmation of the agreement.

2. When selling products to consumers, general terms and conditions may never stipulate an advance payment of more than 50%. When prepayment has been stipulated, the consumer cannot assert any rights regarding the execution of the order or service (s) concerned before the stipulated prepayment has taken place.

3. The consumer has the duty to immediately report inaccuracies in payment details provided or stated to the entrepreneur.

4. In case of default by the consumer, the entrepreneur has the right, subject to legal restrictions, to charge the reasonable costs made known to the consumer in advance.


Article 15 - Disputes

1. Contracts between the entrepreneur and the consumer to which these general terms and conditions apply are governed exclusively by Dutch law.
